(1) NOTICE OF PUBLIC HEARING BEFORE THE CITY COUNCIL OF THE CITY OF REDONDO BEACH TO CERTIFY A NEGATIVE DECLARATION AND INTENT TO ADOPT A MORATORIUM INTERIM ORDINANCE;

(2) NOTICE OF INTENT TO ADOPT/CERTIFY A NEGATIVE DECLARATION; AND

(3) NOTICE OF PUBLIC REVIEW PERIOD AND CIRCULATION OF INITIAL STUDY/NEGATIVE DECLARATION.

    Project Title:    2013 Coastal Zone Electrical Generation Facility Moratorium Interim Ordinance

Notice is hereby given that:

(1)     The City Council of the City of Redondo Beach is scheduled to hold a public hearing on the 2013 Coastal Zone Electrical Generating Facility Moratorium Interim Ordinance and the adoption/certification of a Negative Declaration on Tuesday, December 3, 2013 at 6:00 p.m., or as soon thereafter as possible, in the City Council’s Chambers, 415 Diamond Street, Redondo Beach, CA 90277.

(2)     The City of Redondo Beach as lead agency for compliance with the California Environmental Quality Act (CEQA), intends to adopt a Negative Declaration which will be prepared for the project pursuant the Redondo Beach Municipal Code, and the Guidelines to the Implementation of the California Environmental Quality Act (CEQA).

(3)     The Initial Environmental Study for the proposed project will be available for public review and comment from October 31, 2013 to November 21, 2013 at 5:00 p.m.

Project Location: All properties within the City’s Coastal Zone, which is generally located west of Pacific Coast Highway in Redondo Beach

Project Description: The City of Redondo Beach is proposing to adopt a temporary moratorium on the approval of any conditional use permit, coastal development permit or any other discretionary City permit for the construction, modification or alteration of any electrical generating facilities for the on-site generation of electricity within the Coastal Zone.  To protect the public safety, health, and welfare of its citizens, Government Code 65858 allows a city council to adopt an interim ordinance prohibiting any uses that may be in conflict with contemplated general plan or zoning measures that the city is considering, studying, or intends to study within a reasonable time. This proposed moratorium would apply throughout the coastal Zone in the City of Redondo Beach. While the AES power plant (Power Plant) is the only existing power plant in the City’s Coastal Zone, this moratorium would also prevent any new power plants from being constructed within the project area (e.g., the City’s Coastal Zone).  If the moratorium is enacted, any proposal for new or modified electrical generating facilities within the City’s Coastal Zone would be considered inconsistent with the Ordinance and with the City’s land use policies and zoning regulations.

Findings/Determination: The City has reviewed and considered the proposed project and has determined that the project will not have a significant effect on the environment and this conclusion is supported with substantial evidence in the Initial Environmental Study. The City hereby proposes to adopt a Negative Declaration for this project.

Public Review Period and Written Comments: In compliance with (a) the CEQA Guidelines Section 15105 and (b) the City’s Municipal Code, the public review period for the proposed Negative Declaration/Initial Environmental Study begins on October 31, 2013 and ends on November 21, 2013 at 5:00 p.m. When submitting comments, please include the name of a contact person in your agency or organization. Public Hearing:  The City Council of the City of Redondo Beach is scheduled to hold a public hearing on the proposed project and the adoption/certification of a Negative Declaration on Tuesday, December 3, 2013, at 6:00 p.m., or as soon thereafter as possible, in the City Council Chambers, 415 Diamond Street, Redondo BeachCA, 90277.  The City Council’s procedures generally include opening the public hearing, a presentation by staff, and a question and comment period open to the public.

Document Availability: The Negative Declaration, the Initial Environmental Study, and all documents referenced are available for review at the City of Redondo Beach Planning Division, 415 Diamond Street, Door E, Redondo Beach, CA90277.
