ORDINANCE NO.14-1346
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING THE MUNICIPAL CODE TO DEFINE AND ALLOW “GYMNASIUMS/FITNESS AND HEALTH CENTERS, LIMITED” NOT EXCEEDING 6,000 SQUARE FEET OF FLOOR AREA IN THE M-1 (LIGHT MANUFACTURING) ZONE AND AMEND THE OFF-STREET PARKING STANDARDS FOR GYMNASIUMS/FITNESS AND HEALTH CENTERS (APPLICABLE TO ALL ZONES)
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The term ““Gymnasium/health and fitness center, limited “ is added to the alphabetical list of definitions in Section 17.04.050 of Chapter 17.04 of Title 17 of the Hermosa Beach Municipal Code to read as follows:
“Gymnasium/health and fitness center, limited” means a facility not exceeding 6,000 square feet of gross floor area, whether open to the public or a private club, which provides the indoor space, equipment and the supervision/training/teaching for physical activities including, but not limited to, sporting activities, exercising, martial arts, aerobic dancing, weight training, gymnastics and spas. In this Code, “gymnasiums/health and fitness center” includes this use type “Gymnasium/health and fitness center, limited.”
SECTION 2.The use category “Gymnasium/health and fitness center, limited” is added the alphabetical list of uses in Section 17.28.030 of Chapter 17.28 of Title 17 of the Hermosa Beach Municipal Code to read as follows:
SECTION 3.Section 17.28.040 is added to Chapter 17.28 of Title 17 of the Hermosa Beach Municipal Codeto read as follows:
17.28.040 Gymnasium/health and fitness center, limited.
A. The use shall be conducted within a building and shall not exceed 6,000 square feet of gross floor area.
B. Hours of operation shall be limited to 6:00 a.m. to 9:00 p.m. daily.
C. Bicycle parking shall be supplied at a minimum rate of one (1) per 1,000 square feet of floor area.
SECTION 4.Subsection (E)(11) of Section 17.44.030 (Off-street parking–Commercial and business uses) of Chapter 17.44 of Title 17 of the Hermosa Beach Municipal Code is amended to read as follows:
11. Gymnasiums/health and fitness centers, as follows:
a. less than or equal to three thousand (3,000) square feet and with less than or equal to twenty (20) students at one time if classes are offered: one space per two hundred fifty (250) square feet of gross floor area.
b. greater than three thousand (3,000) square feet but not more than six thousand (6,000) square feet, or with not more than forty (40) students at one time if classes are offered: one space per two hundred (200) square feet of gross floor area.
c. greater than six thousand (6,000) square feet, or with more than with forty (40) students at one time if classes are offered: one space per one hundred (100) square feet of gross floor area.
SECTION 5. This Ordinance shall become effective and be in full force and in effect from and after thirty (30) days of its final passage and adoption.
SECTION 6. Prior to the expiration of fifteen (15) days after the date of its adoption, the City Clerk shall cause this Ordinance to be published in the Easy Reader, a weekly newspaper of general circulation, and circulated in the City of Hermosa Beach in the manner provided by law.
SECTION 7. The City Clerk shall certify to the passage and adoption of this Ordinance, shall enter the same in the book of original Ordinances of said city, and shall make minutes of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted.
SECTION 8.Pursuant to the Code of Civil Procedure Section 1094.6, any legal challenge to the decision of the City Council must be made within 90 days after the final decision by the City Council.

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Hermosa Beach shall hold a public hearing on Tuesday,April15, 2014, to consider the following:
1. Amendment to the Municipal Code, Chapter 17.50 (Signs) to allow permanent banner-type signs on auto sales lots in the C-3 zone and zones that allow C-3 uses and adoption of Environmental Categorical Exemption.
SAID PUBLIC HEARINGS shall be held at 7:00 P.M., or as soon thereafter as the matter may be heard,in the City Council Chambers, City Hall, 1315 Valley Drive, Hermosa Beach, CA 90254.
ANY AND ALL PERSONS interested are invited to participate and speak at these hearings at the above time and place. For inclusion in the agenda packet to be distributed, written comments of interested parties should be submitted to the Community Development Department, Planning Division, in care of City Hall at 1315 Valley Drive, Hermosa Beach, CA 90254 prior to Thursday, April 10, 2014, at 12:00 noon. All written testimony by any interested party will be accepted prior to or at the scheduled time on the agenda for the matter.
