ORDINANCE NO. 3115-13

 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, Amending section 2-6.1.02  of chapter 6.1, title 2 of the REDONDO BEACH MUNICIPAL CODE PERTAINING TO Bid limitations

       WHEREAS, section 2-6.1.02 (d)(2) of the Redondo BeachMunicipal Code defines“public works project” and “public project” to include maintenance, painting, repainting, or repair work, in excess of $50,000 dollars; and

WHEREAS, section 2-6.1.02 (e) of the Redondo Beach Municipal Code provides that “maintenance” includes (1) routine, recurring, and usual work for the preservation or protection of any facility owned or operated by the City for its intended purposes and (2) the resurfacing of streets and highways at less than one inch; and

WHEREAS, the Redondo Beach Municipal Code provides that public projects over $50,000 dollars shall be contracted by formal bidding procedures; and

WHEREAS, formal bidding proceduresfor City maintenance contracts prevent the City from selecting vendors based on experience, subject knowledge, professionalism, and expertise, and therefore, deny the City the ability to procure the highest and best value for the community.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1.  Section 2-6.1.02 of Chapter 6.1, Title 2 of the Redondo Beach Municipal Code is hereby amended as follows:

Subsection (d)(1) of Redondo Beach Municipal Code 2-6.1.02 is hereby renamed subsection (d).

Subsections (d)(2) and (e) of Redondo Beach Municipal Code 2-6.1.02 are hereby

deleted in their entirety.

Subsection (f) of Redondo Beach Municipal Code 2-6.1.02 is hereby renamed subsection (e).

SECTION 2. Any provisions of the Redondo Beach Municipal Code, or appendices thereto, or any other ordinances of the City inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed

SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.  The City Council hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional

SECTION 4.This ordinance shall be published by one insertion in the official newspaper of said city, and same shall go into effect and be in full force and operation from and after thirty (30) days after its final passage and adoption.
