Back in court
A Feb. 22 hearing has been scheduled to potentially set a trial date for a long-running $700 million lawsuit against the city.
The 13-year-old breach-of-contract lawsuit by Macpherson Oil Company has been up and down the state court system before landing back in a trial court, for a showdown that could drive the city bankrupt.
Macpherson Oil once held a contract with the city, allowing the company to slant-drill under the Pacific Ocean from municipal land at Sixth Street and Valley Drive. Then Hermosa voters weighed in against the project in 1995, and a previous City Council in 1998 declared the contract canceled, citing safety concerns.
A state appeals court last year told the city that it can get out from under the breach-of-contract claim if it can convince a jury that the oil drilling project was too dangerous to allow. The California Supreme Court let that ruling stand when it declined to entertain an appeal by the city.
