ORDINANCE NO. 3112-13
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, ADDING ARTICLE 7 TO CHAPTER 1, TITLE 5OF THE REDONDO BEACH MUNICIPAL CODE PERTAINING TO BEEKEEPING PERMITS
        WHEREAS, honeybees are of benefit to mankind by providing agricultural, fruit, and garden pollination services, and by furnishing honey, wax and other useful products; and
WHEREAS, beekeeping without a permit is currently prohibited in the City of Redondo Beach (“City”); and
WHEREAS, the City Council of the City of Redondo Beach (“City Council”) desires to allow beekeeping in the City after obtaining a permit; and
WHEREAS, the City Council finds it is in the public interest to regulate beekeeping to avoid beekeeping from becoming a public nuisance.
WHEREAS, the requirement of a beekeeping permit is in the interests of the public health, safety, property, and general welfare of the City’s residents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Article 7, Chapter 1, Title 5 of the Redondo Beach Municipal Code is hereby added to read as follows:
Article 7. Beekeeping
 5-1.701 Definitions
As used in this Article, the following words, terms and phrases shall have the meanings ascribed to them in this section.
(a)  “Apiary” shall mean the assembly of one or more colonies of bees at a single location.
(b)  “Bee” shall mean any stage of the common domestic honeybee, ApisMellifera species.
(c)  “Hive” shall mean a structure for the housing of a bee colony.
(d)  “Colony” shall mean one hive and its contents and appurtenances, including bees, comb, honey, pollen, brood and appliances.
(e)  “Beekeeper” shall mean a person who owns or has charge of one or more colonies of bees.
(f)    “Requeen” shall mean to replace the queen bee in a colony with a younger and more productive queen, a common practice to prevent bee swarming.
5-1.702Â Â Â Â Â Â Â Â Purpose
The beekeeping requirements established in this Article are intended to regulate beekeeping within the City, to avoid beekeeping from becoming a public nuisance, or otherwise endanger public health, safety, property, or general welfare.
5-1.703 Permit Issuance
 No person shall keep, maintain or allow any hive of bees within the City without first obtaining an annual beekeeping permit in accordance with the following requirements.
 (a)  Person shall obtain the beekeeping permit prior to January 10th of each yearin which they maintain, possess, or are in possession of an apiary, or within 30 days thereafter.
(b)  Person shall submit the application for the beekeeping permit to the City Animal Control Parking Enforcement Unit. At the time of the application for the beekeeping permit, the applicant shall:
(1)Â Â Submit proof of registration as required by the California Food and Agricultural Code and the County of Los Angeles;
(2)Â Â Be in compliance with the requirements of this Article; and
(3)Â Â Pay the application fee as adopted by the City in accordance with Section 5-1.704.
(c)Â Â All applications for a beekeeping permit shall include:
(1)Â Â The name, address, telephone number, and signature of the applicant;
(2)Â Â If the applicant is not the owner of the subject property, a statement of approval signed by the owner of the property on which the hive is to be located; and
(3)Â Â A signed statement from the applicant that he or she will comply with the provisions and requirements of this Article.
(d)Â Â Prior to the issuance of the beekeeping permit, the property described on the application for the beekeeping permit shall be inspected by the City Animal Control and/or Code Enforcement officer.
(e)Â Â The term of the beekeeping permit shall be from the date of issuance to December 31st of the year of issuance.
(f)Â Â Â Â The beekeeping permit shall be renewed each year by submitting a renewal application and meeting the requirements of subsection (b) by January 10th of each year.
5-1.704 Beekeeping Permit Fees
City may adopt a fee schedule. Permitee shall pay the fees in accordance with the adopted fee schedule.
5-1.705 General Requirements
(a)Â Â Hives shall be maintained on a single-family residential property.
(b)Â Â Hives shall be limited to one colony per 3,750 square feet of lot area, and no more than two colonies may be maintained on any single-family residential property.
(c)Â Â Allcolonies shall be kept in inspectable hives consisting of movable frames and combs.
(d)Â Â Hives shall be maintained in sound and usable conditions at all times.
 5-1.706 Hive Placement Requirements
(a)Â Â Hives shall be 10 feet from any property line and screened behind a solid partition, fence or hedge six feet high that extends at least ten feet beyond the hives in each direction to ensure that the bees must fly over the barrier before leaving the property.
(b)Â Â Hives shall be 15 feet from any public walkway, street, or road, or any public building, park or recreation area, or any residential dwelling not belonging to the permittee.
(c)Â Â Hive entrances shall face away from or parallel to the nearest property line.
5-1.707 Hive Management Requirements
(a)Â Â Hives shall be maintained in movable-frame hives with adequate space and management techniques to prevent overcrowding and swarming.
(b)Â Â Hives shall be re-queened at least once every two years to prevent swarming or following any swarming or aggressive behavior.
(c)Â Â Hives shall be isolated from public access by a security fence and prominent signage warning of the presence of a hive.
(d)Â Â Permitee shall maintain an adequate supply of fresh water located close to each colony for the bees to discourage bee visitation at other water sources on adjacent public or private property.
(e)Â Â Hive maintenance materials or equipment shall be stored in a sealed container or placed within a building or other bee-proof enclosure.
5-1.708 Right of Entry for Enforcement
 Animal Control and/or Code Enforcement officers are empowered to enter upon any premises where bees are kept, or upon which there is reason to believe that bees are kept to enforce the requirements of this Article and/or the conditions of the beekeeping permit.
5-1.709 Public Nuisance
Bees or hives shall be considered a public nuisance when any of the following occurs:
(a)Â Â Colonies of bees exhibit defensive or objectionable behavior, or interfere with the normal use of neighboring properties.
(b)Â Â Colonies of bees are living in trees, buildings, or any other space except in movable frame hives.
(c)Â Â Colonies of bees swarm.
(d)Â Â Bees or hives do not conform to federal, state, or local laws.
e)Â Â Hives are abandoned by the resident bees or by the owner.
(f)Â Â Â Â Diseased bees.
5-1.710 Nuisance Abatement
Any person who violates any provision of this ordinance may be served with a written notice to cease or remedy the violation by any law enforcement officer, Animal Control Officer, or Code Enforcement Officer. Upon permitee’s receipt of notice, permitee shall cease or remedy the violation within 48 hours.
5-1.711Violation – Beekeeping Penalties
(a)Â Â Any person who fails to cease or remedy any violation within 48 hours of notice, or who causes a subsequent violation to occur, or whoknowingly or intentionally misrepresents to any officer or employee of the City any material fact in procuring the beekeeping permit provided for by this Article shall be deemed guilty of an infraction.
(b)Â Â The remedies provided in this Article are not exclusive, and nothing in this Article shall preclude any person from seeking other remedies, penalties or procedures provided by law.
 SECTION 2.Any provisions of the Redondo Beach Municipal Code, or appendices thereto, or any other ordinances of the City inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional.
SECTION 4.This ordinance shall be published by one insertion in the official newspaper of said city, and same shall go into effect and be in full force and operation from and after thirty (30) days after its final passage and adoption.

 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA,AMENDING SECTION 1-2.03 OF CHAPTER 2 OF TITLE 1 OF THE REDONDO BEACH MUNICIPAL CODE PERTAINING TO GENERAL PENALTIES AND OFFENSES THAT CONSTITUTE INFRACTIONS
 WHEREAS, the police power granted to cities by the California Constitution authorizes cities to adopt and enforce by any reasonable means ordinances necessary to protect the public health, safety, property, and general welfare of the community; and
WHEREAS, the City Council of the City of Redondo Beach wishes to provide the Police Department and the City Attorney with the most effective statutes to protect the City of Redondo Beach citizens against threats to public health, safety, property, and general welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDONDO BEACH, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 1-2.03, Chapter 2, Title 1 of the Redondo Beach Municipal Code is hereby amended to add the following Code section to the existing list of provisions that may be charged by the City Attorney as an infraction:
5 -1.711Violation – Beekeeping Penalties
SECTION 2. Any provisions of the Redondo Beach Municipal Code, or appendices thereto, or any other ordinances of the City inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed.
